In 2005, The Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) made filing for Chapter 7 bankruptcy more difficult for by implementing the Means Test, which sets standards for qualification. The BAPCPA set forth other new provisions as well.

My son moved to Florida 5 years ago. Purchased ‘cash’ his unit in Seminole. That was the only money he had and he was age 21. Then he found out his condo had a $20,000.00 repair. My mother 78 years old and living off her social security found SunTrust bank which gladly gave her a loan. She has never been able to make a payment on it. He found a job in a bakery full time. Lost his job approximately 2 years ago. Since then he has had anxiety attacks and job searching has become futile. Last year he was exiting the Tyrone mall and he bumper hit a car in front of him which was driven by a woman. The woman’s car was only scratched and her insurance took care of it since it was minor. Geico, his insurance at the time informed my son of that. The woman found herself a good lawyer and sued my son for medical reasons and got $25,000.00 per the judge ruling. My son did not adequately defend himself. She of course lives off of others. He has no income and I am supporting his expenses. Which are electric, condo dues, food/clothing. The prior mentioned bank loan has also been paid by me from the beginning.
I would like to know if bankruptcy is an option for my son. He would then be able to start again. He is 25 years old now and has been dealt a terrible experience in the last few years. My interest also is that if he were to loose his home I would also be losing all the money I have put into it in the last two years. This January I stopped paying the condo dues and the bank loan as it was all too overwhelming for me. Now in June my intention is to start again but would appreciate your advice on the matter.
Does he meet criteria for bankruptcy without losing his home.
